The Bombay High Court has observed that merely liking a post on social media is not an offence under Section 67 of the Information Technology Act, reported Bar and Bench.
However, the High Court added that sharing or retweeting such posts would amount to “transmission” under the provision.
Section 67 of the Act deals with the punishment for publishing or transmitting obscene material in electronic form.
The High Court passed the order on October 18 on the petition of a man named Mohammed Imran Kazi seeking to quash charges against him of making social media posts that led to over 500 Muslims assembly for a procession without a permit, reported The Hindu. The police have alleged that the procession threatened peace and security.
Kazi’s counsel argued that there was no offence against him to show that he committed an offence.
The investigating officer in the case told the court that Kazi had liked a social media post calling for the assembly. However, the officer failed to provide any evidence to support that Kazi had shared or created the post.
The court, however, observed that just liking the post does not attract Section 67 of the Act. It also observed that the section is for obscene and not for “provocative” material.

The Congress on Wednesday filed complaints with the Election Commission against the Bharatiya Janata Party leaders Amit Shah and Himanta Biswa Sarma, alleging that they violated the Model Code of Conduct in their speeches ahead of the Assembly polls next month.
A delegation of senior Congress leaders met Chief Election Commissioner Rajiv Kumar and presented a total of eight complaints to him. Two of the complaints pertain to Shah and Sarma’s speeches in Chhattisgarh.
In his speech on October 16, Shah had referred to the killing of a man named Bhuneshwar Sahu during communal violence in April. “To appease and protect their vote-bank, this Bhupesh Baghel government killed Chhattisgarh’s son, Bhuneshwar Sahu,” Shah had said, according to The Hindu.
The BJP has fielded Sahu’s father Ishwar Sahu as a candidate in the Chhattisgarh election.
On October 16, Congress MP Jairam Ramesh had said that Shah’s claims were false and were aimed at inciting communal violence. He said that the state government had taken prompt action and arrested the accused.
In the complaint against Sarma, the Congress referred to the Assam chief minister’s comments at a rally in Chhattisgarh’s Kawardha district on October 18. It said that he had a “clear cut intention to incite sections of society against one another”.

इंटरनेट डेस्क। समलैंगिक शादियों को मान्यता देने की मांग को लेकर सुप्रीम कोर्ट ने बड़ा फैसला दिया है। इस फैसले के बाद समलैंगिक शादियां करने वालों को झटका लगा है। इस मामले में सुप्रीम कोर्ट ले सुनवाई करते हुए कहा की समलैंगिक विवाह मौलिक अधिकार नहीं है। कोर्ट ने कहा कि ये विधायिका का अधिकार क्षेत्र है।
सुप्रीम कोर्ट की संविधान पीठ ने 3-2 से ये फैसला सुनाया। सेम सेक्स मैरिज पर फैसला सुनाते हुए चीफ जस्टिस डी वाई चंद्रचूड़ ने कहा कि सुप्रीम कोर्ट विशेष विवाह अधिनियम के प्रावधानों को रद्द नहीं कर सकती।
सीजेआई ने अपना फैसला सुनाते हुए समलैंगिक शादी को मान्यता देने से इनकार कर दिया। उन्होंने कहा कि उनकी राय में संसद को समलैंगिक विवाह को मान्यता देने के मामले में फैसला करना चाहिए। उन्होंने समलैंगिक समुदाय के खिलाफ भेदभाव को रोकने के लिए केंद्र और पुलिस बलों को कई दिशा-निर्देश भी जारी किए।

The Mauritius Supreme Court earlier this month declared unconstitutional a law that criminalises consensual same-sex acts between adult men. The decision boosts the trend in the Southern African Development Community region towards decriminalisation. Now, a slight majority – nine out of 16 member states – do not prohibit gay and lesbian sexual relations.
I have researched and taught human rights law in Africa, including the rights of sexual minorities, for over three decades, and closely follow the work of the African Commission on Human and Peoples’ Rights.
The African Commission, as the continent’s human rights custodian, should lend its unequivocal support to the decriminalisation trend. This is particularly significant as attempts are made to further criminalise and stigmatise sexual minorities in parts of Africa.
The commission has not yet expressed its view on the decision. Its 77th ordinary session, starting on October 20 in Arusha, Tanzania, is an opportunity to do so. It should build on its 2014 guidance to African states on eradicating violence based on sexual orientation and gender identity.

Members of the LGBTQIA community on Tuesday expressed their disappointment in the Supreme Court judgement that refused to legalise same-sex marriages and left it to Parliament to formulate a law on the matter.
A five-judge Constitution bench headed by Chief Justice of India DY Chandrachud delivered its verdict on Tuesday in response to a batch of pleas seeking legal recognition for same-sex marriages. The bench, which also included Justices Sanjay Kishan Kaul, S Ravindra Bhat, Hima Kohli and PS Narasimha, delivered four separate judgements.
The court said that it cannot create a legal framework for queer couples because that is the job of Parliament. The bench also said that there is no fundamental right to marriage. Solicitor General Tushar Mehta said that the Centre will form a committee to decide the rights and entitlements of persons in queer unions.
After the judgement was delivered, advocate Rohin Bhatt, one of the lawyers representing the petitioners in the case, said that the verdict has relegated the community to an “unsympathetic” legislature.

The Delhi High Court on Tuesday allowed Aam Aadmi Party MP Raghav Chadha’s plea to stay his eviction from a government-allotted bungalow, reported Bar and Bench.
Chadha had moved the High Court after the additional district judge of Patiala House court on October 5 dismissed an interim order of April 18 that directed the Rajya Sabha Secretariat to halt his eviction.
Additional District Judge Sudhanshu Kaushik had said that Chadha had no right to stay in the bungalow as it was only a privilege given to him as an MP.
In September 2022, Chadha was allotted a type-VII accommodation bungalow in Delhi. The Opposition party’s MP was earlier allotted a type VI bungalow. In March, the Rajya Sabha Secretariat told him that the allotment had been cancelled as the type-VII bungalow was higher than his entitlement, reported Bar and Bench. He was then allotted another flat.
Following this, Chadha sought direction against the decision to cancel his type-VII bungalow allotment. The Patiala House Court granted him interim relief on April 18.

The Staff Selection Commission (SSC) has released the master question paper and final answer key for the Tier 1 Combined Higher Secondary (10+2) Level Examination or CHSL 2023 today, October 17. Candidates who appeared for the exam can download the answer key from the official website ssc.nic.in.
The Tier-I of Combined Higher Secondary (10+2) Level Examination 2023 was conducted by the Commission from August 2 to 17 at different centres all over the country. The provisional answer key was released on August 19 and objections were invited till August 22. The CHSLE 2023 results were announced on October 2. A total of 19556 candidates have qualified for the Tier 2 exam.
“The candidates may take a print out of their respective Final Answer Keys along with respective Question Paper(s) by using the link given below. This facility will be available for the candidates for a period from 17.10.2023 (6:00 PM) to 31.10.2023(6:00 PM),” reads the official notification.

Ukraine on Saturday criticised the statement issued by the G20 leaders on the Russian invasion denouncing the use of force for territorial gain but refraining from direct criticism of Moscow.
“Ukraine is grateful to the partners who tried to include strong wording in the text,” said Oleg Nikolenko, a spokesperson for the Ukrainian Foreign Affairs Ministry. “At the same time, in terms of Russia’s aggression against Ukraine, the Group of 20 has nothing to be proud of.”
The G20 had adopted the New Delhi Leaders’ Declaration, under which member countries committed to ensuring “strong, sustainable, balanced and inclusive growth”. While the declaration called on all states to refrain from using force to “seek territorial acquisition”, it did not specifically mention Russia in the context of the Ukraine war.

American teenager Coco Gauff came from behind to win the US Open on Saturday, clinching her first Grand Slam title with a battling win over Aryna Sabalenka of Belarus.
Gauff, 19, produced a gutsy performance in the Arthur Ashe Stadium to win 2-6, 6-3, 6-2 in 2hr 6min to complete a fairytale transformation in her season’s fortunes.
The sixth seed from Florida had gone into the final as the underdog against the hard-hitting second seed Sabalenka, who will become world No 1 in next week’s rankings.
But with both players making a slew of mistakes throughout an error-strewn final watched by a star-studded record crowd of 28,143 it was Gauff who held her nerve when it mattered to seal a deserved victory.
The win completed a remarkable turnaround for Gauff, who was left distraught after a first round exit at Wimbledon in July.
